Welcome to MyWelder (accessible via www.mywelder.co.uk). MyWelder is an online marketplace platform that connects clients seeking welding and fabrication services ("Clients") with verified professional welding contractors ("Contractors").

By registering an account, posting a project, or bidding on a job, you agree to be legally bound by these Terms and Conditions. If you do not agree to these terms, you must not use the platform.

1. Scope of the Platform

MyWelder is an intermediary marketplace platform. I provide the digital infrastructure for Clients to post jobs and for Contractors to discover and bid on them.

I am not a party to any contract, agreement, or dispute between Clients and Contractors. The actual contract for welding services, as well as all financial transactions, payments, and project terms, is strictly and exclusively between the Client and the Contractor.

2. Contractor Verification and Badges

Contractors may be awarded specific "Verified Professional" badges based on credentials provided during registration (e.g., certifications, qualifications).

While I take reasonable steps to verify these details at the time of onboarding, Clients are ultimately responsible for performing their own due diligence, verifying certifications, and checking insurance before hiring a Contractor.

3. Job Postings, Bidding, and Credit System

  • For Clients: Posting a job is free. You agree to provide accurate, truthful, and lawful descriptions of the work required.
  • For Contractors: To maintain high quality and prevent spam, the platform operates on a limited-bid system powered by platform credits. Contractors must use credits to submit a bid on an active job posting.
  • Credit Refund for Unsuccessful Bids: If you submit a bid on a job but the Client does not select you (the job is awarded to another Contractor, or the job expires/is cancelled without a hire), the credits used for that specific bid will be fully refunded to your MyWelder account balance once the job status is finalized.
  • Credit Expiration: All purchased credits are strictly valid for 60 days from the exact date of purchase. Any unused credits will automatically expire and be permanently removed from your account balance after this 60-day window. Expired credits cannot be reinstated.
  • Strict No Cash Refunds Policy: All purchases of platform credits are final. Under no circumstances will MyWelder issue monetary or cash refunds for purchased, unused, or expired credits. Credits hold no monetary value, cannot be exchanged for cash or currency, and can only be used within the platform as described.

4. Currency and Fees

All transactions, quotes, and platform-related credit purchases on MyWelder are priced and processed strictly in British Pounds (£). Any fees for purchasing credits or platform usage will be clearly outlined prior to transaction confirmation.

5. User-Generated Content and Project Images

Users (particularly Contractors) may upload images, portfolio items, and descriptions of their work to the platform. By uploading any content, you warrant that you own the rights to that content and that it accurately represents your own work.

Furthermore, you grant MyWelder a non-exclusive, worldwide, royalty-free license to use, display, and distribute these images and project descriptions for marketing, promotional, and social media purposes.

6. Intellectual Property

All content, logos, trademarks, website design, graphics, and underlying software code (including the marketplace platform framework) are the exclusive property of MyWelder and its operator. Users are strictly prohibited from copying, reproducing, distributing, or reverse-engineering any part of the platform without explicit written consent.

7. Account Suspension and Termination

I reserve the right, at my sole discretion, to temporarily suspend or permanently terminate any Client or Contractor account immediately and without prior notice. Grounds for termination include, but are not limited to: providing false information during registration, non-professional behavior, abusive or harassing communication, fraud, or any activity that damages the reputation of the platform.

8. Consumer Rights (Consumer Rights Act 2015)

If you use this platform as a consumer (a private individual acting outside your trade or business), nothing in these terms affects your statutory rights under the Consumer Rights Act 2015. Contractors operating on the platform are legally required to provide services to consumers with reasonable care and skill, and materials used must be of satisfactory quality and fit for purpose.

9. Data Protection and Privacy (UK GDPR)

I take data privacy seriously. Any personal data collected through your use of MyWelder will be processed strictly in accordance with the Data Protection Act 2018 and the UK GDPR. For full details on how your data is collected, stored, and used, please review my Privacy Policy and Cookie Policy.

10. Limitation of Liability

To the maximum extent permitted by the laws of England and Wales, MyWelder (and its operator) shall not be held liable for any damages, financial losses, structural failures, personal injuries, delays, or subpar workmanship resulting from a contract or interaction formed through the platform. I do not guarantee that Contractors will complete jobs to a specific standard, nor do I guarantee the financial reliability or conduct of Clients or Contractors.

11. Third-Party Rights

A person who is not a party to these Terms and Conditions has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement.

12. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any legal actions or disputes arising from the use of this marketplace platform shall be subject to the exclusive jurisdiction of the English courts.

13. Company Information (Electronic Commerce Regulations 2002)

MyWelder is operated individually by Andi Kuli as an independent platform provider based in Poole, England.
